End User License Agreement (EULA) for NannyTracker

Effective Date: February 4, 2026

This End User License Agreement (“Agreement” or “EULA”) is a legal agreement between you (“User,” “you,” or “your”) and the operator of NannyTracker (“Company,” “we,” “us,” or “our”), governing your use of the NannyTracker mobile application and related services (collectively, the “App”).

By downloading, installing, accessing, or using the App, you agree to be bound by this Agreement. If you do not agree to this Agreement, do not install or use the App.

1. License Grant

Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on devices you own or control
• Use the App solely for personal, non-commercial childcare tracking and organization purposes

You may not:

• Copy, modify, distribute, sell, lease, or sublicense the App
• Reverse engineer or attempt to extract source code
• Use the App for unlawful or unauthorized purposes

2. Ownership

The App and all related intellectual property are owned by or licensed to the Company and protected by applicable laws. This Agreement grants usage rights only and does not transfer ownership.

3. User Accounts

You may be required to create an account. You agree to:

• Provide accurate information
• Maintain confidentiality of login credentials
• Accept responsibility for activity under your account

4. App Functionality

NannyTracker provides tools to help nannies and employers:

• Track schedules and hours
• Manage childcare tasks
• Track mileage and compensation
• Organize childcare-related information

The App is for informational and organizational purposes only and does not provide legal, payroll, tax, or childcare advice.

5. User Responsibilities

You are responsible for:

• Accuracy of data entered into the App
• Compliance with employment and tax laws
• Proper childcare practices
• Ensuring you have authority to share child-related information

The Company is not responsible for disputes between nannies and employers.

6. Children and Sensitive Information

If you enter information about children, you agree that you have legal authority to do so and will protect confidentiality. The Company does not supervise childcare services.

7. Third-Party Services

The App may integrate with third-party services. The Company is not responsible for third-party content or policies.

8. App Store Compliance (Apple-Specific Terms)

If you downloaded the App from Apple’s App Store:

• Apple is not a party to this Agreement
• Apple has no maintenance or support obligations
• Apple is not responsible for claims relating to the App
• Apple is a third-party beneficiary of this Agreement

9. Updates and Modifications

We may update or modify the App at any time. Continued use after updates means you accept the changes.

10. Privacy

Your use of the App is also governed by our Privacy Policy.

11. Disclaimer of Warranties

THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE.”

We disclaim all warranties including merchantability, fitness for a particular purpose, and accuracy of information.

12. Limitation of Liability

To the maximum extent permitted by law, the Company is not liable for:

• Indirect or consequential damages
• Employment or childcare disputes
• Loss of data or financial losses
• Reliance on App calculations

13. Indemnification

You agree to indemnify and hold harmless the Company from claims arising from your use of the App or violation of this Agreement.

14. Termination

We may suspend or terminate your access if you violate this Agreement or misuse the App. Upon termination, your license ends immediately.

15. Governing Law

This Agreement is governed by the laws of the State of California.

16. Changes to This Agreement

We may update this Agreement periodically. Continued use after updates constitutes acceptance of the revised Agreement.
